My brother(he’s learning disabled) works for PetSmart. He feels and it does seem like the store manager?

doesn’t like him and is looking for a reason to fire him. Any suggestions.

he could sue for a major settlement if the fire him just for some stupid reson cause he is learning disabled

    hmm… I hate people like that.
    The most your brother can do, is to do his best and he get’s fired for a little mistake, you can go to court.

    Find a job that is better suited for him . I dont understand why people think that employers should bend over backwards to accomidate employees . They have a business they are trying to run and make a profit . My Brother in Law is serverly handicapped and I am glad there is a special company that gets government funding to empolye him , but I would not feel it was right to force a company to keep anyone that is not a profitable employee .

    It depends. If your brother is CURRENTLY hooked up with vocational rehabilitation–or similar agency, talk to them. they may be willing to ararange a meeting with the manager and start resolving whatever issues are causing the problem.

    Alternatives: First, if your brother has not told the manager he has a disability–he should sit down and do so. Either way, set up a meeting n your own But carefully–become familier with the company procedures/policy–and tthe legal rights your brother has. You MUST do your homework if you take this course–so you know how to handle it. Ideally you should have someone with you who is a professional (e.g. from a disability advocacy group.)

    In that type of job (retail) it’s unlikely your brother will be able to build a "paper trail" to potect himself. But if the manager engages in any overt discrimination–document it if you can, at least to the extent of recording the names of anyone else present.

    But–if you do believe the problem is a result of discrimination or prejudice because your brother has a disability, go ahead and start job-hunting. He shouldn’t stay in that environment and put up with it a day longer than he has to.

    You brother is hopefully protected by the Disabled Americans act and it gives certain guide lines for if an employer can be sued for discrimination but it has to do with the number of employees work at the particular store. I suggest that you looking into it for your brother and if he is a consumer of your local MHMR and has a job coach talk to his job coach and case manager to see if there is anything that can be done to help. I hope you and your brother luck with this problem.

    There is always two sides to the story.

    Is the reason because he has a problem doing his job or because he doesn’t get along with store manager.

    If your brother has a job coach or overseer, I would speak tell him to speak to his overseer. they can talk to the manager and come in to fit the problem.
    Or you can try a disabilities ambassador

    The smartest thing a disabled person can do is work for a company that has a Union..
    With a union you have protection from this kind of discrimination.
    He might also consider switching to another Pet Smart location.

    Have him start keeping a daily journal about his workday experiences. What did he do, interactions with his manager, etc. That sort of him. A dated journal is usually a good way to keep track of stuff and it might be admissable in court.

    Document anything out of the ordinary. He needs a small notebook to record date and time - he should also record his time clocking in and out - if he is retaliated against, he will have a written record. He MUST follow whatever the protocol is for filing a complaint, geting it settled internally. Read the handbook and see what it says. The ADA will help if it comes to that. Most companies don’t want that fight.
